Probate Court has original jurisdiction over actions concerning the issuance of marriage liscenses, the estate of a deceased person, the will of an individual, the estate of a minor or incapacitated person, trusts, and involuntary commitments. Most probate matters are handled without a jury trial, but Probate Court does have the authority to conduct a jury trial.

The objective of the Probate Court is to be more responsive to the people we serve. It is crucial to put a face on the Court and to convey a sense of responsibility, respect, and compassion towards the people this office serves.

Judge T. Carroll Atkinson, III is a lifelong resident of Marion County and is the son of Mrs. Lucia O. Atkinson and the late T. Carroll Atkinson, Jr. He is a graduate of Marion High School and received a degree in Business Administration from Newberry College. The judge is married to the former Susanne (Jan) Cook and they are parents of three children, Troy, Susanne, and Lucas.

Judge Atkinson is currently a member and past president of Marion Rotary Club, a member of the Marion and Mullins Chamber of Commerce has served as past president of the Marion Chamber of Commerce, past president of the Swamp Fox Booster Club, and member of the State Board of Directors of the Chamber of Commerce for several years. Judge Atkinson is also a former member of the Marion City Council. He is a member of Marion Baptist Church. He has served as Marion County Probate Judge since July 1987.
